By accessing this website, you agree to these Terms of Use which form a legally binding agreement. If you do not agree, please exit this website.

These Terms of Use may be changed by us from time to time without specific notice to you. The latest Terms of Use will be posted on the website, and you should always review these Terms of Use prior to using the website to ensure that you have a current understanding of the Terms of Use under which you are permitted to access this website.

2. Intellectual Property Rights

Mecenat is the owner and/or authorized user of all design, text, content, information, selection and arrangement of elements, organization, graphics, design, compilation and other matters related to this website ("IPR"). Your use of this website does not grant to you a license to the IPR. Nothing contained on this website should be construed as granting any license or right to use any IPR without our written permission or that of the third party rights holder.

4. Personal Data

By agreeing to these Terms of Use, you acknowledge you have read and understood the terms of our Privacy policy and that you agree with it.

With the exception of personal data, any communication or material you post or transmit to us over the Internet is, and will be treated as non-confidential and non-proprietary. Upon the transmission of any personal information to us, you expressly grant permission to us to disseminate and/or use such information for any lawful purpose as detailed in our Privacy policy.

Notwithstanding the foregoing, all personal data provided to us as a result of this website will be handled in accordance with our Privacy policy.

5. Disputes

These Terms of Use and any non-contractual obligations arising out of or in connection with it shall be governed by and construed in accordance with the laws of Sweden, excluding its conflict of laws principles providing for the application of the laws of any other jurisdiction.

Any dispute, controversy or claim arising out of, or in connection with, these Terms of Use, or the breach, termination or invalidity thereof, or any non-contractual obligations arising out of or in connection with these Terms of Use, shall be exclusively settled by the courts of Sweden. The District Court of Gothenburg (Sw. Göteborgs tingsrätt) shall be the court of the first instance.

Mecenat’s general terms and conditions

Mecenat Aktiebolag, company registration number 556317-4076, (”Mecenat”, “we”, “us” or “our”) has a wide range of partners providing different goods and services. Our mission is to provide our members with attractive discount and offers provided by our partners. By signing up for the Membership and accepting these General Terms and Conditions (“General Terms”) You will be able to benefit from our Services.

Mecenat provides its Services through different web based solutions (both its own and its partners’ websites and mobile application(s) and other available technology). The Services and Your Membership are governed by these General Terms.

If You do not accept these General Terms You may not use the Services.

1. Definitions

In these General Terms, the following terms shall have the meaning set forth below.

Membership” means the membership You have to activate to utilize our Services.

Services” means all services we provide to our members, including, but not limited to targeted messages, provision of discounts from our partners, the possibility to forward messages to, and receive messages from, other members and as the services are amended from time to time.

You” means the person using the Services and accepting these General Terms).

Other capitalised words and expressions in these General Terms have the respective meaning ascribed to them elsewhere in these General Terms.

2. Activation of Membership

Our Services may only be utilized if You have activated Your Membership. The Services which you are able to benefit from through the Membership can be subject to change and will also vary depending on, among other things, whether you are a student or a former student.

Your membership covers your study time and then five (5) years as Mecenat Alumn.

In order to activate Your Membership, You will have to be eligible for our Services and have reached the age of sixteen (16).

3. Privacy

Please note that the use of the Services also require that You submit certain personal information and contact information. Mecenat takes data protection very seriously and Your privacy is important to us. Your privacy is governed by Mecenat’s privacy policy as applicable from time to time, which forms part of these  General Terms.

4. Your commitments

We want our Services to be of the highest quality and to the most benefit for our members; therefore we need Your help. This includes the following assurances and commitments from You:

  1. You ensure that You are eligible to utilize our Services.
  2. You ensure You will not disturb, alter or in any other way impede Mecenat’s activities.
  3. You ensure that that the information submitted to Mecenat does not include any incorrect information and You shall continuously procure that to keep the information up to date.
  4. You will not share Your password, let anyone else access Your account, or do anything else that dangers the security of Your account.
  5. You acknowledge and accept that all intellectual property rights relating to the Services belong to Mecenat.
  6. You will comply with all applicable laws when using the Services.
  7. We provide our Services free of charge to You, but You acknowledge that You are responsible for any costs or charges incurred by You due to your use of our Services e.g. applicable data charges by Your communications provider when using the Services through Your technical equipment.

5. Service content

Some Services are supported by advertising revenue and may display advertisements and promotions, and You agree that we may place such advertising and promotions in the Services. The manner, mode and extent of such advertising and promotions are subject to change without specific notice to You.

You agree that we will send out (and that You will receive) advertising, offers and other information concerning Mecenat and the Services, goods and services of Mecenat’s partners and information about Mecenat’s partners via e.g. mail, e-mail, mobile phone, Mecenat’s and its partners’ mobile applications or other available technology.

You are aware that the information we provide, including any Service content, may be wholly or partly erroneous or incorrect, and that You are responsible for Your use of the information we provide.

6. Amendments

Mecenat reserves the right to change these General Terms at all times. In order for You to review the revised terms before continuing Your use of the Services, we will notify You by providing a notice through the Service and/or by sending You an e-mail.

If You do not agree with the new General Terms and Conditions You are free to reject them. Unfortunately You will then no longer be able to access or use our Services. If You use our Services in any way after a change to the General Terms, You agree to the new version of the General Terms.

7. Termination

The Services may be terminated at any time, with immediate effect, by You or by Mecenat.

If You want to terminate the Services simply notify us by sending an e-mail to us using the contact information provided below under section 11. Should we want to terminate your Membership we will either notify You by e-mail or mail.

8. Indemnification and Limitations of liability

If anyone brings a claim or dispute against us related to Your use of the Services for illegal activities or other acts or activities by You, You will indemnify and hold us harmless form and against all damages, losses and expenses of any kind, including reasonable legal fees and costs, related to such claim.

10. Miscellaneous

These General Terms, including the Privacy Policy and Cookie Policy, constitutes the entire agreement between You and Mecenat regarding the Services and the Membership.

Mecenat has the right at any time, and without obtaining the prior approval, to modify the design, operation and performance of the Services.

If any part of these General Terms is considered being invalid or unenforceable due to applicable mandatory law, the remaining part shall remain in full force and effect.

Any waiver of these General Terms must be made in writing and duly signed by Mecenat. If we do not enforce any of these General Terms, it will not be considered as a waiver.

You will not transfer any of Your rights or obligations under these General Terms to any third party without our consent.

All of our rights and obligations under these General Terms are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

Nothing in these General Terms shall prevent us from complying with the law.

We reserve all rights not expressly granted to You.

These General Terms were written in English. In the event of a conflict between the English version and a translated version of these General Terms, the English version shall apply.

Mecenat’s Privacy policy

1. Introduction

Mecenat Aktiebolag with company registration number 556317-4076 (“Mecenat”) aims to offer its members attractive discounts and offers from its partners. Mecenat is responsible for the processing of your personal data as the data controller. All references in this privacy policy to “we”, “us” and “our” shall be deemed to be a reference to Mecenat.

We respect your privacy and are committed to protecting your personal data. This privacy policy, inter alia, contains information about the purposes for which we process your personal data, with whom we share it, and what rights you have in relation to your personal data.

2. The scope of the privacy policy

This privacy policy covers Mecenat’s processing of its members’ personal data. Mecenat members are those who have activated a user account through any of Mecenat’s sites or our mobile app.

3. Which categories of personal data do we process and for what purpose and what is the legal basis for our processing of personal data?

All the categories of personal data processed by Mecenat are shown in the table below.

The purposes for which Mecenat processes your personal data is also listed below. For each purpose Mecenat must have a legal basis. For example, a legal basis may be (i) your consent to the relevant processing activity, (ii) that the processing is necessary in order for the performance of a contract to which you are a party, or (iii) that Mecenat or a third party has a legitimate interest to process the personal data which is not overridden by your interest of not having the personal data processed. Under each purpose listed below, the legal basis that Mecenat relies on will be identified.

If your consent is the legal basis for a purpose listed below, we will not process your personal data for such purpose without having obtained your consent thereto. Furthermore, you have the right to withdraw your consent at any time by changing the settings under “My Profile”. Please note that the withdrawal of consent does not affect the lawfulness of the processing based on such consent before its withdrawal.

The period we need to store your personal data that is processed for each purpose is also shown in the table below.

If automated decision making (including profiling) is used to fulfil any of the purposes, information about this will also be provided when processing your personal data which is described in the table below.

  • Behavioural patterns (data about discounts and information you have searched for and/or related links that you have clicked on our sites, in our mobile app and in email mailings).
  • Technical data relating to devices used and their settings (IP address, operating system and platform).
Legal basis:Consent.

 

We will ask you to provide your consent for the processing for the above purpose. Giving your consent is completely optional but is necessary for us to target customised offers as well as suggestions and information to you personally. You have the right to withdraw your consent at any time without giving any reason. We will not process your personal data for this purpose without you first giving your explicit consent.

4. How long do we store your personal data?

We store your personal data for as long as it is necessary for each purpose and as shown in the table above. We may save the data for a longer period than the one specified for each purpose if this is necessary to determine, exercise or defend legal claims.

5. Collaboration concerning your personal data

The information we collect from the partners listed in section 6 below and the sharing of your personal data with the parties listed in section 8 is only for the purpose of enabling you to access Mecenat’s services as set out above. We will never sell or share your data or retrieve data for any other purpose or to any extent that cannot be justified on these grounds.

6. From where do we obtain your personal data?

Mecenat collects personal data directly from you through your visits to our sites and in our mobile app, when you register as a member. Your personal data will also be collected if you contact our customer service through mail, email, our chat function or through our social media.

Mecenat also collects personal data from the following sources:

  1. Your student union.
  2. The educational institution you are studying at/studied at.
  3. Our partners (the companies offering you discounts and offers through Mecenat’s services).
  4. Distributors of our partners (service provider acting as an intermediary between us and our partners).

7. What happens if you do not provide us with your personal data?

Some of the personal data you provide us is necessary in order for us to fulfil our obligations under the agreement that we enter into when you activate your user account. An example of this is that we cannot activate your user account unless you provide information about your email address. If you choose not to provide such personal data that we collect from you and which is necessary for us, we cannot deliver our services to you. The data that is necessary to provide us with in order to use our services will be stated when we ask you to provide it.

8. With whom do we share your personal data?

In order to fulfill the purposes listed above, Mecenat will share your personal data with the following recipients.

  1. Suppliers for the production and delivery of the Mecenat card.
  2. Our partners (the companies offering you discounts and offers through Mecenat’s services).
  3. Distributors of our partners (service provider acting as an intermediary between us and our partners).
  4. Technology providers (suppliers who store your data on our behalf and provide us with IT support for our sites and our mobile app).

9. Will we transfer your personal data outside the EU/EEA?

There may be occasions when certain tasks classified as personal data by GDPR are stored outside the EU / EEA. Sensitive personal data will always be stored within the EU / EEA

10. Automated decision making/h2>

For Mecenat to fulfil the purpose of offering, providing and managing membership, so-called automated decision making is carried out. In the automated decision making process, your scope of study is analysed to determine if you are entitled to student discounts that require a certain scope of study. The information about your scope of study is obtained from your educational institution or your student union.

The information about your scope of study obtained by Mecenat forms the basis of the automated decision that determines if you are entitled to a certain discount. This information is relevant because some of our partners have decided that only students or, in some cases, students who study to a certain extent, have the right to receive their discounts. The decision will mean that your eligibility will be shown on your Mecenat card, which you can use as proof of your eligibility.

You are entitled to make personal contact with Mecenat, which means that you may contact us using the contact details in section 12 to comment on and contest the decision.

11. What rights do you have?

Below is a summary of the rights you have under European data protection legislation. The exercise of these rights is free of charge and you may exercise the rights by contacting us (see contact information at the end of this privacy policy).

Please note that Mecenat will always make an assessment of a request to exercise a right to determine whether the request is valid. All rights listed below are not absolute and exceptions may apply.

In addition to the rights listed below, you are always entitled to file a complaint with a regulatory authority regarding Mecenat’s processing of your personal data.

In addition to the rights set forth below, you always have the right to lodge a complaint with a supervisory authority regarding Mecenat’s processing of your personal data.

  1. Right of access. You are upon request entitled to receive a copy of your personal data that Mecenat processes and also to obtain supplementary information about Mecenat’s processing of your personal data.

  2. Right to rectification. You have the right to have your personal data corrected and/or completed if it is inaccurate and/or incomplete.

  3. Right to erasure. You have the right to request that Mecenat erases your personal data without undue delay in the following circumstances:

    - the personal data is no longer necessary in relation to the purposes for which they were collected or otherwise processed;

    - you withdraw your consent to a processing activity and there is no other legal basis for the processing;

    - you make a valid objection to the processing of your personal data;

    - the personal data has been unlawfully processed; or

    - the personal data has to be erased for compliance with a legal obligation.

  4. Right to restrict processing. You have the right to request restriction of the processing of your personal data in the following circumstances:

  5. - the accuracy of the personal data is under examination;

    - the processing is unlawful or is no longer needed for the purposes of the processing but you oppose the erasure of personal data and request restriction instead;

    - Mecenat no longer needs the personal data but you need the personal data for the establishment, exercise or defence of legal claims; or

    - you have objected to the processing of your personal data and such objection is under verification.

  6. Right to data portability. Under certain circumstances you have the right to receive the personal data concerning you which you have provided to Mecenat in order to transmit these to another service provider if the processing of the personal data is based on your consent or the performance of a contract.

  7. General right to object. You have the general right to, at any time, object to the processing of your personal data that is based on Mecenat’s legitimate interests. If you object we have to demonstrate that we have compelling legitimate grounds for such processing or that we need the personal data for the establishment, exercise or defence of legal claims.

  8. Right to object to direct marketing. You have a right to, at any time, object to the processing of your personal data for direct marketing purposes. If you do this, Mecenat may no longer process your personal data for such purposes.
